1. Who we are and acceptance. This website is operated by Riley Botha doing business as Motion Network ("we," "us," "our"). By accessing or using this site, our community, or any of our products or services, you agree to these Terms of Use and the Privacy Policy below. If you do not agree, do not use the site.
2. Eligibility. You must be at least 18 years old and legally able to enter into a binding agreement to use this site or buy anything from us. Our content is not directed to anyone under 18. You are responsible for knowing and following the laws that apply to you where you live.
3. Education only; no advice; no relationship. Everything we publish or say, on this site, in videos, social media, Discord, live sessions, mentorship or elsewhere, is general educational and entertainment content. It is not personalized investment, financial, legal, accounting, tax or trading advice, and it does not take into account your goals, finances or risk tolerance. Using our content does not create an advisory, fiduciary, broker, agency or other professional relationship. You should speak with a qualified, licensed professional before making financial decisions. You alone are responsible for your trades and your results.
4. No guarantees. We do not guarantee any outcome, including profits, passing a prop firm evaluation, receiving a funded account, receiving payouts, or the accuracy or completeness of any content. Trading involves substantial risk of loss (see the Risk Disclosure above).
5. Third-party companies and services. This site links to and uses services provided by other companies, such as prop firms, Whop, Discord, YouTube, TikTok, Instagram, X and HighLevel. We do not own or control them, are not responsible for their content, products, prices, rules, payouts, availability, privacy practices or terms, and any dealings you have with them are between you and them. Their terms and policies apply to your use of their services.
6. Paid products. The Motion Network mentorship, the live trading room and any other paid offer are subject to the terms shown at the time of purchase or application, including price, billing frequency and access. Mentorship is by application, and we may accept or decline any applicant. Memberships may renew automatically until you cancel, and cancellations and refunds are handled according to the terms presented at checkout and the policies of the payment platform used (for example Whop), except where the law requires otherwise. Access may be limited, paused or removed if you break these terms. You are responsible for any taxes that apply to your purchases.
7. Community conduct. If you join our community or live sessions, you agree not to harass or abuse others, post unlawful, deceptive or spam content, impersonate anyone, share private information, or share, resell or leak our paid content or access. We may remove content or members at our discretion. Opinions shared by community members are theirs alone and are not endorsed by us.
8. Intellectual property. The site, videos, trading models, course material, text, graphics, logos and other content are owned by or licensed to us and are protected by law. You may view them for your personal, non-commercial use. You may not copy, record, redistribute, resell, publish or create derivative works from them without our written permission. Third-party names, logos and trademarks belong to their owners.
9. Disclaimer of warranties. The site and all content, products and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law. We do not promise that the site will be uninterrupted or error-free.
10. Limitation of liability. To the fullest extent permitted by law, we and our owner, employees, contractors, affiliates and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, trading losses, loss of data, or loss of opportunity, arising out of or related to your use of or inability to use the site, our content or our services, or any dealings with third parties, even if we were told such damages were possible. To the extent liability cannot be excluded, our total liability for any claim is limited to the amount you paid us for the product or service giving rise to the claim in the 12 months before the claim arose. Some places do not allow certain limits, so some of this may not apply to you.
11. Indemnification. You agree to defend, indemnify and hold harmless Riley Botha, Motion Network and their owners, employees, contractors and affiliates from claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your use of the site or services, your trading or financial decisions, your breach of these terms, or your violation of any law or third-party right.
12. Disputes and governing law. These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Before filing a claim, you agree to first contact us and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be decided by final and binding arbitration on an individual basis (not as a class, collective or representative action) under the rules of a recognized arbitration provider, held in Illinois or remotely, except that either side may bring an individual claim in small-claims court and either side may seek court relief to stop misuse of intellectual property. You and we waive the right to a jury trial and to take part in class actions to the extent the law allows.
13. Changes and ending access. We may update the site, these terms, offers and discounts at any time. Changes take effect when posted, and continuing to use the site means you accept them. We may suspend or end your access at any time.
14. General. If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with the policies on this page and any checkout terms, are the entire agreement between you and us about the site. Our failure to enforce a right is not a waiver of it.
